The last Italian justice system reform (Decree-Law n. 132/2014) is yet another mockery of a government incompetent and ineffective. It will not help to reduce the backlog of lawsuite to be disposed, nor will short the time of the future ones.
The core of the law, that, to be clear, should help in the disposal of several lawsuits pending for a long time, provides that upon any stage and level of the procedure, the parties may apply to the arbitrators. But is it credible that parts of lawsuite, having paid heavy taxes of Justice already, substantial attorneys' fees, should be happy to pay more money to go to a costly arbitration instead of the justice of the State, even if it does not work fast? Certainly not. It is more credible that theywill prefer to keep on the began road. So, nothing will change.
The other articles of the Decree-Law, relating to the stage of the enforcement proceeding, and having the aim to make it more effective and faster will, also, be negligible in scope. In short, a futile reform, which certainly does not ensure justice faster or more reliable, or more effective.
Once again Government has lost a good opportunity to do one of those many reforms that could entice foreign companies to carry out productive investment in Italy.
